Question 1

Can I rent my granny flat to anyone in NSW? 👥

Accepted Answer

Yes, in most cases. Once your granny flat has valid approval, NSW tenancy law lets you rent it to anyone, not just family. The one exception is a granny flat approved through a DA due to site factors like flood or fire risk. Some of these approvals carry a condition limiting occupancy to a household member only. Always check your consent conditions before advertising for a tenant.

Question 2

Do I need a special permit to rent out my granny flat? 📜

Accepted Answer

No. There's no separate "granny flat rental permit" in NSW. Once your secondary dwelling has valid planning approval, whether through CDC or DA, you can lease it like any other rental property. You'll still need a standard Residential Tenancy Agreement. You must also lodge the bond with the NSW Rental Bond Board, exactly as you would for a house or unit.

Question 3

Can I rent my granny flat out as an Airbnb? 🏖️

Accepted Answer

You can, but short-term rentals face extra rules under the state's Short-Term Rental Accommodation framework. From mid-2025, NSW tightened these requirements. You'll need to register your property and display your registration number. Long-term rentals don't need this extra step. Some councils also apply their own local conditions on short-term rentals, so it's worth checking with your council first.

Question 4

What happens if my council approved my granny flat through a DA? 🏛️

Accepted Answer

Check your consent conditions closely. Some DA approvals, often needed for fire-prone, flood-prone, or battleaxe blocks, include a condition that limits occupancy to a member of your household. If you want to rent to the open market instead, you may need to apply to have that condition varied. A CDC-approved granny flat typically carries no such restriction.

Question 5

What are my responsibilities as a granny flat landlord in NSW? 🛡️

Accepted Answer

The same as any residential landlord. You must keep the property safe and habitable, handle repairs promptly, and maintain working smoke alarms. You're bound by the Residential Tenancies Act, just as you would be for a house or apartment. Treating your granny flat with the same care and compliance as your main rental property keeps you on the right side of the law.
